This warranty is offered for the Polyester and PVC coated Aluminum Trim Coil (the “Product”) manufactured by First American Resources Company, LLC (“First American”).

WARRANTY COVERAGE

Subject to the terms and conditions set forth in this warranty, First American warrants to you, the property owner, that for a period of ten (10) years from the date of Product installation, the Products are free from manufacturing defects and will not crack, flake or peel (loss of adhesion) to an extent that is apparent on ordinary outdoor visual observation.  This warranty does not cover crazing or slight cracking as may occur on tightly formed edges or break bends of severe embossing, each of which is accepted as standard.  This warranty is not transferable.

WHAT DOESN’T THIS WARRANTY COVER

This warranty does not cover damage of any kind resulting from anything, other than a manufacturing defect, including but not limited to faulty or improper installation or application of the Products, accidental damage, impact of foreign objects, distortion of the property structure, vandalism, misuse, fire, hail, earthquake, lightning, hurricane, tornado, windstorm, ice, flood, or other acts of God, physical abuse, harmful chemicals, pesticides; direct contact with and water run-off from dissimilar metals or other materials (e.g., metals such as copper, zinc and steel, or other materials such as concrete, blacktop, stucco, asbestos siding, pressure treated or pre-treated lumber, roofing materials or roofing systems containing metallic granules or strips, or other corrosive non-metallic materials); surface discoloration due to normal weathering, air pollution, fumes, vapors, mold, mildew, sea salt in the atmosphere, warping or distortion due to exposure to excessive heat, your failure to provide reasonable and necessary maintenance (please see care and maintenance instructions), Products that have been altered in any way or any other causes beyond our reasonable control.  Furthermore, failure due to substrate corrosion is not a covered warranty condition.

 

LIMITATIONS OF LIABILITY

Under this warranty, First American’s total liability shall be limited to, and in no event, exceed, the original purchase price of the Product.  Upon the proper notification (as outlined below) and validation of a claim, at our option, we will replace, repair or refund to you the value of the defective Products.  In the event your Product is no longer available, First American shall have the right to substitute a product it considers of equal quality and price.  Since color variance may occur between the originally installed Product and its replacement due to normal weathering and aging, this will not constitute a defect in either the original or the replacement Product.  Any additional costs and expenses beyond these amounts will be the sole responsibility of the warranty holder.  In the event of repair or replacement of material under this warranty, the repaired or replaced material will be warranted only for the remaining time under the original warranty.

 

HOW TO REGISTER YOUR WARRANTY

In order for this warranty to take effect, you must complete the Warranty Registration Form found at https://warranty.farcllc.com/content/trim-coil-warranty within 30 days after original Product installation has been completed.  This is essential for the traceability and verification of the Product in the event a warranty claim situation arises.  First American recommends retaining your proof of purchase in case it is needed if you submit a warranty claim.

 

HOW TO SUBMIT A CLAIM

You must submit your claim in writing within (60) days of the date the defect is first discovered or could have reasonably been discovered.  Please provide the following information:  a description of the claimed defect; the date it was discovered; the date of the original installation; a copy of the original receipt from installation and your name, address and phone number.  Claims should be emailed to:  warranty@farcllc.com.  First American will provide notification of any additional information and physical evidence that may be required to process your claim.  All additional information must be provided at the homeowner’s expense.

 

ANY REPAIR OF THE PRODUCTS WITHOUT PRIOR WRITTEN CONSENT FROM FIRST AMERICAN WILL VOID THIS WARRANTY.

 

GOVERNING LAW

With respect to any claims arising out of or in connection with this warranty, the warranty holder and First American  specifically consent to jurisdiction in federal court within the Northern District of Georgia or any state court within Cobb County, Georgia, which courts shall together constitute the exclusive forum in which disputes arising out of this warranty are to be resolved, the parties specifically submitting to personal jurisdiction and waiving all objections to jurisdiction and venue.
